The Drivers’ Hours and Tachographs (Amendment and Modification) Regulations 2025

These Regulations, effective April 21st, 2025, amend and modify EU regulations on drivers' hours and tachographs to reflect the UK's post-Brexit relationship with the EU, as per the Trade and Cooperation Agreement.

Key changes include adjusting the scope of Regulation (EC) No 561/2006 and amending its definition of "special regular passenger services." Furthermore, the regulations modify Regulation (EU) No 165/2014, extending the record-keeping period to 56 days and making consequential amendments to Commission Regulation (EU) 2016/403.

Arguments For

  • Alignment with International Obligations: The amendments ensure UK regulations align with the Trade and Cooperation Agreement (TCA) with the EU, facilitating continued trade and transport.

  • Clarity and Specificity: The changes clarify the definition of "special regular passenger services," providing more precise criteria and examples that are consistent with the TCA.

  • Improved Record-Keeping: Extending the record-keeping period under Regulation (EU) No 165/2014 to 56 days improves operational efficiency and reduces the risk of penalties for drivers.

  • Legal/Historical Basis: The regulations are made under the powers conferred by the European Union (Future Relationship) Act 2020, demonstrating a legal basis within the UK for making modifications post-Brexit.

Arguments Against

  • Potential Compliance Costs: Businesses might face costs in adapting to the new regulations, particularly with adjusting record-keeping systems and staff training.

  • Implementation Challenges: Ensuring consistent enforcement of revised rules across different parts of the UK and preventing discrepancies could present implementation challenges.

  • Unintended Effects: Unexpected consequences might arise from amending EU regulations, possibly affecting certain transport sectors or causing unintended complexity in the system.

  • Alternative Approaches: The government could have explored alternative ways to address the issues presented by Brexit, perhaps focusing on negotiation of broader trade agreements or a more fundamental rewrite of domestic legislation.

Regulation 2 amends Regulation (EC) No 561/2006 to— (a) adjust the scope of application of that Regulation in order to align with international obligations within the TCA; (b) amend the definition of “special regular passenger services” in order to make clear that such services must also meet the requirements of “regular passenger services”, and to set out specific examples of special regular passenger services as provided under Article 474 of the TCA; (c) omit provision which relates to international occasional passenger services, as such journeys no longer fall within scope of Regulation (EC) No 561/2006, and the related definition. Regulation 3 modifies Regulation (EU) No 165/2014 to implement the requirement under Article 10 of Section 4 of Part B of Annex 31 to the TCA, which requires drivers of vehicles within scope of that Article to keep tachograph records for 56 days, rather than 28 days. Regulation 4 makes consequential amendments to Commission Regulation (EU) 2016/403 of 18 March 2016 supplementing Regulation (EC) No 1071/2009 of the European Parliament and of the Council with regard to the classification of serious infringements of the Union rules, which may lead to the loss of good repute by the road transport operator, and amending Annex III to Directive 2006/22/EC of the European Parliament and of the Council, which relates to infringements committed by operators of goods and passenger vehicles.
